Chapter 1 General Provisions

Article 1 Purpose

The purpose of the Terms and Conditions of Use is to define the provisions related to the use conditions and procedure of the general service offered at the website (http://www.corwinservice. co.kr) of COWIN SERVICE CO., LTD., and other necessary provisions.

Article 2 Definitions

The term used in the Terms and Conditions of Use is defined as follows.

• ①Termination: defined as the termination of use contract by a firm or member

Article 3 Notification, Effect and Modification of Terms

①The terms and conditions of use are posted on the area of Agreement on the Terms and Conditions of Use. The company is entitled to change the terms and conditions if there are changes in reasons and important reasons for business. The changed terms and conditions shall be posted in Notice.

②The Terms and Conditions of Use and any changes of the terms and conditions made according to the company circumstances are effective when they are posted to users.

Article 4 Rules Other Than the Terms and Conditions of Use

Any matters not specified in the Terms and Conditions of Use shall be governed by the provisions of the Framework Act on Telecommunications, the Telecommunications Business Act, the Act on the Consumer Protection in Electronic Commerce, etc., the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Documents and Transactions, Digital Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, Etc., Consumer Protection Act, and other relevant laws.

Chapter 2 Use Contract

Article 5 Application for Use

①When a use applicant agrees on the Terms and Conditions of Use and Personal Information Protection Policy in the subscription procedure and then clicks ‘OK’ button in the registration procedure (which requires an applicant to fill in a subscription form of the company), it is possible to apply for use.

②Unless a user enters its real name and information, the user is not entitled to have legal protection and can face the limited use of service.

Article 6 Acceptance of the Application for Use

①The company shall give the acceptance of service use to a use applicant according to Article 5 with the exceptions of the paragraphs 2 and 3 of this Article.

The company is entitled to postpone the acceptance until the cause for the limitation is solved if any of the following occurs.

• a. If there is no extra equipment related to service
• b. If there is any technical obstacle
• c. If there is any reason to be accepted according to the company circumstances

The company is entitled to refuse acceptance if any of the following occurs.

• a. If an applicant uses a different person’s name
• b. If an applicant writes false user information
• c. If the application is made for the purpose of impeding the peace and order of society or public morals
• d. If there is a lack of application requirements defined by the company

Chapter 3 Obligations of Contracting Parties

Article 7 Obligations of the Company

①The company has an obligation to run the website in a stable and continuous way.

②If an opinion or complaint of a user is accepted to be reasonable, the company shall immediately handle it. If it is hard to handle the opinion or complaint immediately, the company shall notify the user of the reason for non-handling and a handling schedule through Notice in the website or e-mail.

③The paragraph 1 of this Article shall be exceptional if a relevant organization or Information Communication Ethics Committee makes a request or presents a warrant for the purpose of investigation, or if there are other related laws.

Article 8 Obligations of Users

①A user shall fully understand and observe the Terms and Conditions of Use, notices, and use information at this website and shall not take any action of obstructing business.

②A user shall not use this website to take any profit-making activities without any prior approval of the company.

③A user shall neither use the information obtained by this website nor provide it for others in such ways as copying, replication, change, translation, publication, and broadcasting without any prior approval of the company.

Chapter 4 Service Offering and Use

Article 9 Service Use

①A user shall comply with the provisions defined in the Terms and Conditions of Use in order to use the website.

②The matters related to service use not specified in the Terms and Conditions of Use shall be posited in the ‘Notice’ or shall be announced separately.

Article 10 Information Offering

The company may offer a member a variety of information accepted to be needed in service use through e-mail or postal mail.

Article 11 Advertisements

①The company may post an advertisement related to service operation in service page, home page, or e-mail.

②The company is not responsible for any loss or damage caused as the result of a member’s participation in the promotion activity of an advertiser posted in the site, or of a member’s communication or transaction. Article 12 Limitation of Service Use

Article 12 Limitation of Service Use

The company may limit a user’s service use if the user’s use and action is subject to any of the following.

• ①If it impedes the public order, public morals, or the order of society
• ②If it is aimed for a criminal act, or is objectively accepted to be related to other criminal acts
• ③If it damages others’ honor, or noticeably impedes others’ service use
• ④If the content or advertising information against others’ will continues to be transmitted
• ⑤If it impedes the sound operation of service through hacking or computer virus spreading
• ⑥If it violates intellectual property rights of other users or third parties, or if an intellectual property owner is judged to argue the violation of its intellectual property right
• ⑦If a different user’s ID and password are stolen
• ⑧If it violates other related laws or is judged to be improper as a user’s act

Article 13 Suspension of Service Offering

The company is entitled to suspend a part or the whole of service if any of the following occurs.

• ①If a backbone network provider or an internet provider defined according to Telecommunications Business Act suspends service
• ②If the service fails to be provided due to power failure
• ③If unavoidable circumstances, such as transfer, repair or construction of equipment, occur
• ④If it is difficult to provide the service normally due to a failure of service equipment or a deluge of service use
• ⑤If a war, an uprising, a natural disaster, or a state of national emergency arises or is likely to occur

Article 14 Management of Posted Messages

In order to establish the sound communications culture and operate the site efficiently, the company is entitled to delete, move, or reject to register the materials posted or offered by a user at its discretion if the materials are judged to be subject to Article 12.

Article 15 Responsibility of Service Use

A user is not entitled to have any business activities of selling illegal products with the use of the service except for the detailed explicit written permission made by an authorized employee of the company, and especially is not allowed to do hacking, money-making advertising, commercial acts through pornographic sites, and illegal offering of commercial S/W. The outcomes and loss of business activities and legal punishments including imprisonment by an authorized organization, which arise as the result of violation, are not under the responsibilities of the company.

Chapter 5 Others

Article 16 Exemption and Compensation

①If the service fails to be offered due to natural disaster or equivalent irresistible force, the company shall be exempted from the responsibility of service offering.

②The company is not responsible for any outcomes arising in the transaction relationship between users or between a user and a third party.

③The company is not responsible for the accuracy and reliability of the information, data, and content posted by a user, and a user shall use the website under its responsibility.

④Any damage related to posted or transmitted materials, selection of materials, any disadvantages related to free service use shall be under the responsibilities of a user.

⑤If a user’s violation of the Terms and Conditions of Use causes damage to the company, the user shall compensate for all the damage and shall indemnify the company against the damage.

Article 17 Dispute Settlement

①The company and users shall make all possible efforts to settle any dispute related to the use of this site smoothly.

②If a lawsuit is filed despite the paragraph 1 of this Article, the lawsuit shall be under the jurisdiction of a competent court at the location of the head office of the company.

Supplementary Provisions

The Terms and Conditions of Use is applied from 2020.
